Orders
As far as orders arec oncerned, it is necessary, for each
item, to specify the description, code and quality. Quotation and supplies are
always carried out at our unit Busnago, carriage costs exscluded. Except for
special and exportation wrapping, packing is free of charge. Packing returns of
are not accepted. Orders for special executions must be previously agreed and
cannot be cancelled. In case of non collection of special executions, within 30
days from the fixed term, we will deliver directly at the domicile of the
client, or, in case of refusal, by depositing goods on behalf and at the
expenses of purchaser at a public deposit, according art 1514 c.c.
Prices
The catalog does not indicate list prices. Prices list are
provided solely and exclusively to Authorized Resellers. Any request exceeding
standards by us established is communicated to the closest Authorized Reseller.
Prices established are subject to revision in case of relevant increases in the
costs of raw materials, labour or any other major burder (fiscal, tax, or due to
fluctuations of the exchange rates, etc.). We reserve ourselves to adjust prices
keeping in mind the burdens above mentioned, even after the stipulation of the
contrat and with a previous written notice.
Deliveries
Terms of deliveries, even if by us explicity accepted,
are never to be intended as essential, according to art. 1457 c.c., and eventual
delays due to causes indipendent from our will, cannot result in
cancellations.
Payments
Payments must be carried out at our domicilie within the
agreed term, indicated in the invoice. Rouding or discounts are not accepted. In
case of delays in payments, overdue interests will amount to Twice the Legal
interest. It is our right to cancel, interrupt, refuse eventual orders in case
of delayed payments.
Shipping
Goods sent by us always travels at the risk of the
purchaser. Thust is in the interest of the receiver to act promptly against the
carrier in case of damages or disapperance of goods.
Returns
Returns of goods due to our mistakes will be credited for
the entire value; other returns must be previously agreed and authorized by
written notice, and carried out carriage free solely at our unit in Busnago. Our
products are guaranteed against faults due to construction materials or defect
in workmanship; faulty products must be delivered at our expenses to the unit in
Busnago and will be substituted free of charge; faults deriving from causes
which are not due to us are excluded from such guarantee. We cannot be held
liable for any director or indirect consequence or damage deriving from the good
delivered.
Claims
The only daims accepted are those written whitin 8 days from
delivery of the good.Claims or protests do not allow interruptions or delays in
payment.
Contracts
We declare that all our sales contracts are ruled by the
present general condition of sale, of which clients are made aware by means of
catalogs and commercial documents. The present conditions are considered
accepted lacking different agreements, carried out by written notice. Eventual
general contract conditions printed on purchase orders of purchasers are not
allowed. We reserve ourselves the right to modify our products without any
obligation to provide information. Product modifications are always an
improvement and to not imply a modification of fungibility.
Court of Competent Jurisdiction
All relationships between our
Company and clients belong to the exclusive competence of Monza Court of
Justice.
